Resumen:
El proyecto de investigación «Los delitos de opinión y libertad de expresión: un análisis interdisciplinar. La ¿(de) construcción de una sociedad (in) tolerante?» tiene por objeto analizar, desde una perspectiva interdisciplinar, las respuestas dadas por el Derecho, tanto nacional como internacional, a un conflicto clásico —el de la libertad de expresión y la protección de otros bienes jurídicos como límites—. Pretende examinar si los delitos de opinión son una herramienta de protección de determinados bienes jurídicos, y como tales contribuyen a reforzar una sociedad tolerante o si, por el contrario, pueden llegar a ser potencialmente una herramienta de deconstrucción de una cultura de libertades individuales. Todo esto desde una perspectiva interdisciplinar y transversal, que va desde la filosofía del Derecho y del Derecho internacional de los derechos humanos hasta el Derecho penal sustantivo y procesal, prestando especial atención a las bases constitucionales, al Derecho administrativo y al Derecho civil. También tiene como finalidad investigar las razones por las cuales se aprecia un incremento en las sentencias condenatorias por delitos de opinión. En este sentido, se pretende constatar si tal aumento es el reflejo de una sociedad cada vez más polarizada e intolerante o, si por el contrario, se debe a una interpretación excesivamente amplia de estos delitos por parte de los tribunales.
Abstract
The research project «Crimes of opinion and freedom of expression: an interdisciplinary analysis. The construction of an (in)tolerant society?» Its objective is to analyze, from an interdisciplinary perspective, the responses given by Law, both national and international, to a classic conflict—that of freedom of expression and the protection of other legal rights as limits. It aims to examine whether crimes of opinion are a tool for the protection of certain legal rights, and as such contribute to strengthening a tolerant society or whether, on the contrary, they can potentially become a tool for deconstructing a culture of individual freedoms. All this from an interdisciplinary and transversal perspective, which ranges from the philosophy of law and international human rights law to substantive and procedural criminal law, paying special attention to constitutional bases, administrative law and civil law. It also aims to investigate the reasons why there is an increase in convictions for crimes of opinion. In this sense, the aim is to determine whether such an increase is a reflection of an increasingly polarized and intolerant society or, on the contrary, is due to an excessively broad interpretation of these crimes by the courts.
